Domestic patent application roadmap
Filing a provisional application
Provisional application can be used if papers have not yet been published.
- Papers or lab notes can be submitted as they are to secure patent filing dates. This is known as provisional application in the United States.
- Filing a provisional application saves time in drafting a full patent specification, which speeds up the patent application process.
- A formal application must be submitted within one year of filing the provisional application. Provisional application costs are not supported by the school (under-paid after invention evaluation)
Patent application process should be initiated as soon as possible if papers have been published.
- Patent applications can be filed within one year from the publication date (journal publication, seminar presentation) in Korea, US, Japan, etc. (not possible in China and Europe).
- Specify the publication date in the invention report.
Overseas patent application roadmap
Comparison of PCT international application and general overseas application procedures
Overseas application strategy
To retroactively apply the point of determining the patentability of the invention to the initial domestic filing date, overseas application or PCT application must be completed within one year from the initial domestic filing date !- Application in one or two countries, target country can be determined, overseas application costs are manageable -> More advantageous to apply directly to the country concerned (based on the Paris Convention)
- Target country difficult to confirm, overseas application costs are considered expensive as almost one year has elapsed from the initial filing date → Bear the cost of PCT application to gain an additional six months(PCT application cost is used to secure more time)
